Selling a Manvel Home With Flood History: What You Disclose and What to Gather

Which flood questions does a Manvel seller answer on the disclosure notice?

Three numbered items. Senate Bill 339 rewrote the flood part of the notice in Texas Property Code Section 5.008 for contracts entered into on or after September 1, 2019. Item 6 asks whether you are aware of present flood insurance coverage, of flooding caused by a reservoir failing or releasing water, and of water getting into a structure on the property in a natural flood, and then whether the lot lies wholly or partly in a 100-year floodplain, a 500-year floodplain, a floodway, a flood pool or a reservoir.

Item 7 asks whether you have ever filed a claim for flood damage to the property with any insurer, the National Flood Insurance Program included, and item 8 whether you have ever received FEMA or Small Business Administration help for flood damage to it. Each of the three ends with a line for explaining a yes, with room to attach more pages. Water damage that did not come from a flood, a burst pipe for instance, is a separate box in item 4, beside improper drainage.

What do you write when you do not know whether the house flooded?

That you do not know. Section 5.008(d) has the seller fill in the notice to the best of their belief and knowledge on the date they sign it, and a seller who marks an answer as unknown has complied with the section by doing so. An owner who bought the house after a storm may never have been told what happened before it.

What you do know goes on the explanation lines: when water came in, how high it reached, what was repaired and by whom, and the claim number if there was one. The notice reaches the buyer on or before the contract's effective date. A buyer who signs without it may end the contract for any reason within seven days of receiving it, so it belongs in the listing file from the first day.

Does a flood claim from years ago still go on the notice?

Yes. Items 7 and 8 ask whether you ever filed a flood claim or ever received FEMA or SBA flood help for the property, so the questions reach back through your whole time with the house rather than stopping at the current policy year.

Collect the paper behind each yes before the house is listed: the claim number and the date of loss, what the insurer paid, the contractor's invoices and the permits for the repair. A buyer pricing flood cover during the option period asks for the same records, and an answer on paper reads better than one from memory.

Does flood insurance follow the house to the buyer?

A National Flood Insurance Program policy can. The standard dwelling policy lets the insured assign it in writing when title passes to someone else, unless it covers only personal property or a building still under construction. Keep the declarations page in the file so a buyer's insurance agent can weigh taking the policy over against writing a new one.

One federal rule puts a duty on the seller. Where federal disaster aid to repair the house was given on condition that the owner carry flood insurance, 42 U.S.C. Section 5154a has the seller tell the buyer in writing, no later than the transfer and inside the transfer documents, that flood insurance must be bought and kept. A seller who skips that notice can be made to repay the government if the buyer lets the insurance lapse, the house floods again and federal aid pays for the repair.

Where does the elevation certificate for a Manvel house come from?

FEMA describes the elevation certificate as the record showing that a new or substantially improved building in a mapped flood hazard area is properly elevated, and owners use it to buy flood insurance. For a new home in a floodplain inside the City of Manvel, the city's permit packet has a registered engineer, architect or land surveyor submit elevation certifications to the city's floodplain administrator three times: with the permit application, after the foundation forms are up, and at completion before the final inspection.

If your house was built under that rule and the certificate is not among your closing papers, ask the city's Development Services office what it holds for the address before you pay for a new one. Put the repair permits and the final inspection beside the claim records. A buyer reading a yes on item 6 wants to know what was done, by whom and when, and a permit on file with the city answers part of that without anyone having to remember.
